Judge Wants Proof Of Foxy's Hearing Loss Before Considering A Sentence Reduction Eminem has yet to respond to the offer, nor his recent health scare over the holidays in which he reportedly suffered from severe pneumonia and a heart condition.
The judge in Foxy Brown's plea to be released from jail, due to potential damage to hearing, wants proof.
According to the Associated Press, New York Supreme Court Justice Melissa Jackson said she wanted proof on Thursday (January 17) that the rapper is in fact in danger of losing her hearing unless she can be released to travel to Los Angeles' House Clinic for treatment and repair of a defective cochlear implant.
The rapper (real name: Inga Marchand) revealed in the past -- after several setbacks in the recording of her Def Jam album Black Roses -- that she at one point had lost her hearing. After surgery, however, it was repaired.
Now, as she sit in jail, serving a one year sentence for violating her probation (see "Foxy Brown Sentenced To One Year In Jail"), Foxy claims her hearing is worsening, and if she remains behind bars without treatment, it could result in serious harm.
The judge wants proof before any decision is made.
Foxy's lawyer, Laura Dilimetin, told the judge on Thursday that her client is asking that her sentence be amended so she can make a trip to L.A.
The D.A., however, objected, saying the rapper -- as an inmate -- doesn't have the right to her own doctor and/or a reduction in her sentence.
"The mere existence of a debilitating health condition does not merit a sentence reduction, even if it is a terminal illness," Assistant District Attorney Cindy Chung told the judge, according to the AP. "Basically, your honor, this is a desperate and frivolous petition."
The judge ordered Dilimetin to submit Foxy's medical records to the district attorney, the Department of Correction and the Department of Probation, so each could file position papers.
Before leaving the courtroom, the rapper revealed to the judge that her time behind bars has been good for her -- claiming she has learned to think before she acts.
"I have too much talent to throw it away," she said. "I know I will make you proud and my family proud."
AKON'S FAN-TOSSING CASE POSTPONED
Akon's court date for hurling a fan from the stage into the audience has been adjourned until March 5 following an appeal by his lawyer to have it postponed.
The Senegalese singer is facing misdemeanor endangerment and harassment charges after throwing a teen fan from the stage during a June concert in Fishkill, NY. The boy was singled out for allegedly throwing an object onto the stage.
The teen landed on another concertgoer, who later claimed she had suffered a concussion. The entire incident was captured by cell phone cameras in the crowd and posted onto various online sites, including YouTube.
In December, Akon pleaded not guilty to charges of endangering the welfare of a minor and second-degree harassment. His lawyer Benjamin Brafman successfully had his request to postpone the trial granted during a hearing Wednesday at Fishkill Town Court.
Nate Dogg Paralyzed Following Stroke
The once "go to" man for hooks, singer Nate Dogg, is reportedly paralyzed on the left side of his body after suffering from a stroke during the holidays.
After being reported during the first days of the New Year's, the only information regarding the rapper's condition is that he spent nearly eight days confined to a hospital bed at the Pomona Valley Hospital from December 19th until December 26th when he was originally reported as released.
MTV just got word that he is still suffering from the mild stroke, from his manager on Thursday (January 17). Despite being paralyzed, Nate Dogg (real name: Nathaniel Hale) is expected to make a full recovery.
He is currently residing in an occupational rehab facility.
"Time will tell everything, obviously. The doctor can only guess what the outcome will be," the singer's rep, Rod McGrew, said. "But based on situations with similar people his age, and based on his health, the prognosis is good right now."
Earlier this week, more information regarding Nate's stroke surfaced on TMZ, when the gossip site released an audio clip -- that McGrew confirmed with MTV -- of Nate Dogg's girlfriend phoning 911 after the singer collapsed.
With the current situation, McGrew asked that Nate and his family be given privacy as he recovers from the unfortunate event. But did say that the singer welcomes all the support he has received thus far.
"On behalf of Nate, he would like to thank all of the well wishers, both friends and fans," McGrew said. "He appreciates it deeply, and he plans on fully recuperating and getting back in the studio."
Pastor Troy & Rick Ross Battle Over Roy Jones?
There’s a big battle this weekend between Roy Jones Jr and Felix “Tito” Trinidad in a boxing match being billed as “Bring On The Titans” at Madison Square Garden in New York this Saturday (Jan 19th). But there might be another battle on the horizon as Rick Ross and Pastor Troy are both making claims to accompany Roy Jones Jr to the ring.
Initial reports from Ross’ camp said that the husky rapper will be performing as Roy Jones comes to the ring before the fight. Ross and Jones are both from Florida so it seemed like the combination would make perfect sense.
A day after the Rick Ross release was issued to media outlets, Pastor Troy’s camp made claims that they would be coming down to the ring with Jones. It has been reported that Troy wrote Jones’ theme music for the fight and the song would be performed on Saturday.
“We doin it,” Pastor Troy said in a statement issued. “My travel arrangements are set. Just watch the fight and you'll see the The Pastor of Disaster and Roy Jones Jr. is coming down to the ring!”
Rick Ross’ camp has issued no statement as of press time. The world will have to wait and see if it will be Ross or Troy walking to the ring on Saturday night. Stay tuned!

Sean Paul Song Causes Woman To Have Seizures
Sean Paul's music receives all different types of reactions from listeners. For one Queens, New York resident, that reaction was a seizure.
According to New York's Daily News, certain songs became a literal health hazard to Stacey Gayle and she underwent surgery to put an end to it.
Gayle, 25, suffers from epilepsy and even while on medication, for four years she still suffered from sporadic seizures.
In 2006, she realized that music, specifically Sean Paul's song "Temperature," could trigger her attacks.
As Gayle would come to find out, other popular tracks like Sean Kingston's "Beautiful Girls" and Rihanna's "Umbrella" were also to blame. As a result of the musically triggered seizures, Gayle was forced to drop out of school, quit her job as a bank customer service rep and no longer go to church - where she was a member of the choir.
Hoping to put an end to her worries, Gayle contacted Dr. Ashesh Mehta, a neurosurgeon and director of epilepsy surgery at Long Island Jewish Medical Center in New Hyde Park.
At first the doctor was suspicious of Gayle's case, admitting the odds of Gayle having musicogenic epilepsy - a disease where seizures are triggered by music were very rare. "There are only 50 to 100 cases ever reported of this disorder."
But his suspicions were put to rest once he witnessed Gayle having a seizure after listening to Sean Paul's song.
So, on Oct. 3, Gayle underwent surgery and doctors removed a 3-inch portion of her right front temporal lobe. This is the same area that processes music.
Yesterday (Jan.17) Gayle told the Daily News "I don't know why Sean Paul was giving me seizures. But as soon as the beat came on, it just triggered a seizure. I'd go somewhere and I'd be like, 'Don't play that song!'"
The surgery was a success and Gayle has since returned to her normal life. She is back in her church choir and is also attending YorkCollege where she is studying to become a teacher.
She did admit though, that it took her a month to gather enough courage to listen to "Temperature" again.
Despite all she's been through, Gayle is still a fan of Sean Paul, admitting, "I think his music is awesome. Now I can see why everyone liked this song."
The Carter III Gets Release Date
Universal Records, Cash Money's parent company, has announced a release date for the highly anticipated album, The Carter III.
The LP, which Wayne said wasn't sure when it was going to hit stores, has been scheduled for release on March 18th.
According to Weezy, the LP features productions from Timbaland, David Banner, Jay Bezel (Diplomats), T-Mix, Mannie Fresh, Cool & Dre, & Just Blaze.
Universal will also be putting out David Banner's The Greatest Story Ever Told on March 25th, and Nelly's fourth solo LP, Brass Knuckles, on June 24th.
All release dates mentioned above are subject to change.

Legend On Board For In-Flight Grammy Gig
To help commemorate the 50th anniversary of this year's Grammy Awards, organizers have tapped five-time Grammy winner John Legend to perform an in-flight acoustic concert for 50-60 sweepstakes winners.
Details are still being worked out, a Grammy spokesperson tells Billboard, but Legend will perform a 30-minute set aboard a Delta Air Lines, Grammy-branded Boeing 757. The flight will leave New York on Feb. 7 en route to Los Angeles. This year's Grammy Awards will be broadcast Feb. 10 from L.A.'s Staples Center on CBS.
Contestants can enter the sweepstakes by visiting the Web sites of participating CBS stations and affiliates, which include such cities as New York, Chicago, Los Angeles, Boston, San Francisco, Baltimore and Denver.
Along with the in-flight performance, grand prize winners will receive paid airfare, hotel accommodations, a $200 gift card and two tickets to the Grammys.
Meanwhile, as part of the new deal between the Recording Academy and Delta, the airline company will keep the Grammy-branded Boeing 757, which features a gramophone logo, in its fleet for the next three years, according to a Grammy spokesperson.
Ludacris Launches New Restaurant Venture
Ludacris is teaming with San Francisco Bay area restaurateur Chris Yeo to launch a joint restaurant venture.
According to MSNBC, Ludacris purchased a property in Midtown Atlanta at 793 Juniper St. (at Fifth Street) for $2.7 million in March 2007 that will be the first location under the new venture.
Ludacris and Yeo plan to open three restaurants together, with the first being born under the Straits name of which Yeo owns three locations. The other restaurants currently don't have names. All three will open in metro Atlanta.
Buying real estate is nothing new for Ludacris although he chooses to keep those business interests private.
"I don't generally speak about it," he said. "I keep it to myself. I'm definitely into real estate. I'm a silent partner and an entrepreneur outside of music."
The new Ludacris backed Straits location, which the rapper reportedly invested $1 million into for renovations, should open in April and can seat between 200 and 215 people, not including an outdoor patio.

Remy Ma's Lawyer Pulls Another No Show, Judge Clearly Annoyed
Bronx rapper Remy Ma's assault case hearing was postponed for a second time this morning (Jan. 17) because her lawyer, Ivan Fisher, is still ill.
As previously reported, Remy's pre-trial hearing, which was originally scheduled for January 10, was put off until today (January 17) after the rapper's lawyer first called out sick.
Remy who stands accused of shooting long-time associate Makeda Barnes- Joseph twice in the abdomen, strolled into the courtroom this morning around 9:45 a.m. wearing a long black coat, a gray sweater dress and boots.
Judge R. Uviller was clearly annoyed with the delay. She explained that the purpose of this hearing was to set a trial date and that it was "not a date for us to all come and look at each other...I'm going to make it very clear," the judge said. "I need him [Fisher] to appear here."
All parties will return to Manhattan Criminal Court on January 31 to set a definite trial date.When approached, the Bronx-bred lyricist had no comment about her upcoming trial but offered this statement, "Lil' Kim is washed up."
Rock’s Attorney Says Client Is “Accused Of Being A Pimp”
As was reported yesterday, Rock of Heltah Skeltah was arrested [click here to read]. Late yesterday, Rock’s attorney, Kenneth Montgomery, spoke reporters to clarify the nature of the charges being levied against Rock [real name Jamal Bush].
“Allegedly he’s charged with shooting someone with a gun and causing paralysis,” explains Mr. Montgomery. “The person that he’s alleged to have shot is an admitted, known pimp, as well as a blood gang member. [Rock] allegedly shot this person over a dispute between girls, who the girls belonged to. Rock is also accused of being a pimp himself.”
While only accusations have been made about Rock’s activities and he has not been formally charged or indicted for Enterprise Corruption [a.k.a. pimpin’], he is currently being held on $125,000 bail for very serious allegations being made about his alleged actions on December 20, 2007 at 2:44 A.M. on Church Avenue in Brooklyn, New York.
Rock was arraigned at 12:30 P.M. yesterday on charges of assault in the first, second and third degree, and attempted murder in the second degree. “Attempted murder and assault in the first are basically the same charge,” his lawyer explains. “They’re the highest counts. They’re B [class] felonies, in which he faces 5 to 25 [years in prison] for each [count]. Mr. Bush categorically and unequivocally denies all charges. We will vigorously defend [against] these false charges.”
Rock’s next court date will be held tomorrow [January 18th], at which time formal charges should be filed against him. “Under New York law he has to be formally charged or indicted within the next five days or he’s released, pending subsequent indictment for the next six months,” says Mr. Montgomery. “So in other words, since he’s in jail and they got him on a $125,000 bail they have to indict him. If they don’t indict him he will be released.”
Although Rock could possibly be released from custody as early as tomorrow, he will likely still stand trial for these charges. “Obviously the complainant has a credibility issue,” begins Mr. Montgomery, “but it’s gonna be a case that’s probably gonna have to be tried based on the seriousness of the injuries.”
''American Gangster'' Hit With $55 Mil Lawsuit, Ex-DEA Agents Claim Slander
Makers of the Denzel Washington blockbuster American Gangster are facing a $55 million libel suit levied by three former Drug Enforcement Administration (DEA) agents who say the film inaccurately portrayed them as criminals and diminished their role in taking down Harlem heroin dealer Frank Lucas.
According to New York's Daily News, the former agents say they were slandered by the quote appearing at the end of the film, which stated that Lucas' "collaboration led to the convictions of three-quarters of New York City's Drug Enforcement agency."
Their lawsuit says the film inaccurately asserts that Lucas cooperated with New Jersey police officer and prosecutor Richie Roberts in order to help convict corrupt law enforcement officers.
"Millions of people were induced to pay for viewing this film who would not have paid had they known the truth," the suit says. "The movie is riddled with falsity. ... The whole premise of American Gangster would have been eviscerated if the truth were revealed and the defendant would not have made the money it did make if the libel was not made."
Dominic Amorosa, the lawyer handling the libel suit, also led the prosecution team who convicted Lucas and 18 others in their 1975 federal trial. He said with certainty that Lucas' testimony did not lead to the conviction of a single officer of the law.
"He [Lucas] cooperated very substantially, no question about it, but not against officers of the law," Amorosa told the Daily News. "He cooperated against his competitors."
"It's really egregious," Former DEA agent Jack Toal, one of the plaintiffs in the suit, said of the film. "It doesn't make any sense, and maybe they should answer why they did it."
The suit follows on the heels of numerous previous complaints about inaccuracies by former DEA agents who were involved in the case, as well as the real Richie Roberts, portrayed in the film by Russell Crowe. In November, retired New York DEA agent Gregory Korniloff sent a cease and desist letter to NBC Universal and demanded a retraction of statements made in the film.
Michael Moses, a spokesman for Universal Pictures, said the suit is "entirely without merit ... American Gangster does not defame these or any federal agents."
A DEA spokesman said no agents were ever charged with wrongdoing in the case.
The plaintiffs are asking for part of the $130 million box-office gross, a statement from producer NBC Universal telling "the truth" about the agency's role in the Lucas case and a "class-action" certification that could allow hundreds of DEA agents to share in any award.
American Gangster comes to DVD on February 19.
"The cause of death for Mr. Turner is cocaine toxicity with other significant additions contributing," Paul Parker, the chief investigator at the medical examiner's office, said in a statement earlier Wednesday. Those other factors included hypertensive cardiovascular disease and pulmonary emphysema.
Parker concluded that Turner's death would be ruled accidental, although an official announcement has not been made.
Though Turner was a famed musician and record producer, he was best known for his rocky relationship with Tina Turner and the claims of spousal abuse that she brought against him. During the 1980s, Turner was convicted of drug-related charges, and he was later sentenced to serve several years in a California state prison.
In recent years, Turner sought to ensure his legacy in a brighter light. He won his first Grammy Award in 2007 for Best Traditional Blues Album thanks to his Risin' with the Blues LP. And in a 2000 appearance on VH1's "Behind the Music," Turner seemed to recognize his need to come to terms with his past tribulations.
"I went back over my complete life, man, and I see the things that I did that was good and I see things that I've done that was wrong," he said. "I don't wanna be remembered as the demon they made me [in the media]. ... People that know me, what they really know I am, that's what I want to be remembered for."
On December 22, a funeral and memorial service were held for Turner in Gardena, California, south of Los Angeles. Phil Spector and Little Richard were among those who eulogized the late rock and roll pioneer, with Richard calling Turner "one of the greatest musicians I have ever met in my life."
Turner was 76 years old.
Feds Say Philly Label Head Was Drug Kingpin, Point to DVD as Evidence
The federal trial of Philadelphia record label head and promoter Alton Coles, who stands accused of distributing millions of dollars in cocaine, got under way on Wednesday (January 16).
According to the Associated Press, in February 2007 prosecutors handed down a 194-count indictment against the head of Take Down Records, claiming that he moved $25 million in cocaine through the Delaware Valley and used the record label as a front for his illegal activity.
In addition to weapons and drugs seized in raids on Coles home and the homes of his associates, the Feds will show jurors a 31-minute DVD called New Jack City: The Next Generation that depicts the defendant as a ruthless crack kingpin named Ace Capone.
Coles’ attorney, Christopher Warren, denies that the role his client portrays in the film has any basis in reality and says that prosecutors are misinterpreting phone conversations that were recorded during the investigation.
“It was an art film and it was imitating life—just not his life,” Warren told jurors. “Some of these conversations that the government says are so damning … is actually him discussing props. These are movies about the drug culture.”
But the Feds disagree with Warren’s theory and say that Take Down Records was simply a shell company established to launder illegal funds from the drug trade. They even claim that Coles actually lost money on some of his legitimate ventures, such as a 2002 concert in Philly that featured Jay-Z and Beane Sigel. “When you look behind the storefront, there was nothing there—nothing except the drugs and the guns and the violence,” Assistant U.S. Attorney Michael Bresnick remarked in his opening statement. The trial is estimated to last about two months.
The 'Gangsta Image' Ain't Nothing To Lupe Fiasco
Chi-town rapper, Lupe Fiasco, may be a skateboarder, but that doesn't mean he ain't tough or scares easy. Nope, he' rougher than you can imagine.
In a recent interview in the latest issue of Entertainment Weekly, Lupe talked a little about his life as a child and he said the gangsta image doesn't scare him. In fact, he revealed that he used to call out gangbangers who stepped to him.
"When the gangbangers would try to pull it, I was like, 'Yo, I will f--- you up. And if you wanna call your cousin, call him. I'll call me! I'll call me right now," the rapper told the magazine (via quotes Rap-Up pulled from the interview).
The rapper went on to reveal that his upbringing is a little rougher than most would imagine, and went as far as to say he was "shooting Tec-9s" as a child.
"We were shooting TEC-9s when we were babies, so the whole gangsta image, that ain't nothing," he said. "When I was growing up, there was a crack house next door to us and they were trying to expand. My father was like, 'Are you serious?' He took his gun, walked next door, and said, 'You’re done,' while I aimed my gun out of the window. I was 13 or 14 and to see that, a lot of the facade and the upkeep [of trying] to impress people was eliminated very early for me."
Ginuwine Sues Label For Breach Of Contract
Ginuwine is filing another lawsuit against King Music Group and Michael Bourné for breaching a contract with the R&B singer again.
This is just the latest in a drawn out drama between the singer and King Music, beginning when the crooner inked a deal with the label last year, according to the Business Wire.
The contract with King Music Group, Inc. - a company formed by pal Bourné of Memphis, Tenn. -- outlined terms providing Ginuwine with $1.75 million to record his first album with the company, including a $500,000 advance. But the singer never received payment and later found that there is no corporate record for King Music Group, Inc. anywhere in New York, California, Florida or Tennessee.
Ginuwine launched a lawsuit based upon that scheme and reached a settlement deal with the company. Now the singer claims that Bourne defaulted on the deal and hasn't paid him pursuant to their agreement.
"It is our belief that Mr. Bourné never intended to follow through with his and King Music Group's obligations under the Settlement Agreement," Ginuwine's attorney Brandon J. Witkow said via a statement. "Mr. Bourné has continuously misrepresented his intent and ability to comply with his promises. As a result, Ginuwine has no other choice but to pursue further legal action to obtain compensation for his lost professional opportunities and other damage he has suffered."
So Ginuwine is suing again. He filed a complaint yesterday (Jan. 16) in the United States District Court Southern District of New York for breach of contract and fraud against King and Michael Bourné.
He's alleging that these latest breaches in contract, have caused significant damages to his career, kept him from professional opportunities and recording new material.
Ginuwine went double platinum with his albums The Bachelor and 100% Ginuwine. His subsequent sets, The Life and The Senior were both certified gold.

In this week's Hip-Hop and R&B charts, the post-holiday sales slump may have set in, but Alicia Keys reclaims her spot at No. 1 while Mary J. Blige, Chris Brown and, yes, Fergie, hang tough in the Top 10.
Alicia Keys regains her spot at No. 1 with her third album, As I Am, which sold 70,300 copies this week according to Nielsen SoundScan. After nine weeks, Keys has amassed an impressive total of 2,725,900 albums sold.
Sliding one spot to No. 4 is the Queen of Hip-Hop/Soul Mary J. Blige, whose eighth studio album, Growing Pains, sold 63,900 copies this week. After four weeks, Blige's sales totals hover just below platinum at 988,400.
Chris Brown slips one to the No. 7 spot this week with his sophomore effort, Exclusive, which sold 29,800 copies. After 10 weeks on the charts, the teen phenom has sold 1,121,800.
Fergie jumps two spots to No. 10 this week with her solo debut, The Dutchess, which moved 27,600 copies in the last seven days. After a whopping 69 weeks, the former Black Eyed Pea singer continues to defy the odds with sales totals standing at 3,331,100.
Keyshia Cole drops one spot to No. 12 this week, selling 27,000 copies of her second album, Just Like You. After 16 weeks, Cole has scanned 1,002,600 discs.
Chi-town rapper Lupe Fiasco falls seven spots to No. 23 with his second album, Lupe Fiasco's The Cool, which sold 20,500 this week. After four weeks, the album has moved 249,800 units.
R&B Crooner Jaheim slips three spots to No. 27 this week, selling 20,000 copies of Makings of A Man. After four weeks, the album has sold 276,900 copies.
Chicago rapper/producer Kanye West rises two spots to No. 31 this week with Graduation, which sold 17,900 this week. After 18 weeks, Mr. West is approaching double platinum status with 1,932,500 sold.
West mentor Jay-Z slips four spots to No. 33 with the concept album American Gangster, which hustled 17,300 copies this week. After 10 weeks, the God MC has moved 928,300 units.
Birdman falls three spots to No. 39 with 5 * Stunna, which sold 14,700 this week. After five weeks, the avian rapper and Cash Money CEO has scanned 208,100 discs.
Soulja Boy plummets 13 spots to No. 40 with his debut album Souljaboytellem.com, which sold 14,200 this week. After 15 weeks, the teen rapper has cranked out 697,000 copies.
Superproducer and possible steroid user Timbaland jumps three spots this week to No. 42 with Shock Value, which moved 13,900 in the last seven days. After 41 weeks, Timbo continues to hang tough, selling a total of 1,034,500 copies.
Legally troubled but musically gifted British singer Amy Winehouse jumps five spots to No. 46 with Back to Black, which moved 13,300 this week. After 44 weeks, the album has scanned 1,466,200 copies.
Def Jam hitmaker The-Dream jumps eight spots to No. 47 with Love/Hate, which moved 12,700 this week. After five weeks, the writer behind hits including Rihanna's "Umbrella" and J. Holiday's "Bed" has moved 141,300 copies.
Speaking of J. Holiday, the young crooner climbs two spots to No. 48 with Back of My 'Lac, which sold 12,500 this week. After 15 weeks, the R&B newcomer has moved 440,100 copies.

A Grammy-winning R&B singer from the popular '90s group Blackstreet was caught and jailed yesterday after a year-long search.
Chauncey Hannibal, a.k.a. Chauncey Black was captured in Los Angeles and extradited to Virginia Beach where he is currently being held without bond, according to the Associated Press. The singer faces charges of grand larceny, failure to pay child or spousal support and failure to appear in court on a misdemeanor charge.
The misdemeanor charge stems from a skipped court date back in September of '07. During that court date Black was scheduled to be sentenced for contempt of court and violating terms of his probation, according to online records.
He is also being held for grand larceny on a January 2007 warrant, according to police spokeswoman Margie Long.
Chauncey allegedly broke into a house on the Chesapeake Bay and made out with everything, including the kitchen sink. Apparently, after the singer was evicted in July, it is believed that he came back and looted and destroyed the property. The property owner filed a police report.
Virginia Beach City Jail spokeswoman Lisa Godley wouldn't say exactly how Black was caught or offer any other details.
Blackstreet was founded in 1992 by Teddy Riley, the artist who was already famous from his tenure with R&B group Guy. The group, best known for the hit singles "Before I Let You Go" and "No Diggity," reached the height of its success in 1997 earning a Grammy.
Blackstreet split in '99 over legal issues and when it got back together to release Level II in 2003, Chauncey was no longer a member.
The 39-year-old has not yet made a statement.

Foxy Brown Requests Early Prison Release for Hearing Treatment
Incarcerated rapper Foxy Brown has asked a New York judge for an early release from the Rikers Island correctional facility so that she can travel to Hollywood to receive treatment for her hearing problems.
According to the New York Daily News, Fox attached a handwritten note to a motion filed by her lawyer requesting that sent Judge Melissa Jackson grant the release in time for a January 30 appointment.
“I am terrified of not hearing a fire alarm go off, or being locked in a cell, and someone not being kind enough to let me out, since not everyone understands the severity of my condition,” she explained in the letter.
Foxy underwent special surgery in 2006 to treat her sudden and sever hearing loss.
Now, the battery on a hearing device she uses has malfunctioned. Her attorney, Laura Dilimetin, noted in her motion that there may be “one or two places” in New York that can fix the cochlear implant, but the Los Angeles based House Clinic is the only place that can properly repair the device.
The Daily News reports that the troubled Brooklyn MC insisted in her letter to Judge Jackson that she has a “good heart” and asked the court to consider the good things she has done that don’t get any press.
“’Foxy Brown gets into an altercation with a neighbor’ would be great front-page headlines, whereas ‘Foxy Brown brings Christmas toys to 30 disabled children’ would hardly be mentioned,” she reasoned.
Rock of Heltah Skeltah Arrested For Attempted Murder
Today, representatives from Duck Down Records revealed that yesterday, Rock also known as Da Rockness Monsta was arrested for allegedly being involved in an attempted murder. While details are presently sketchy at best, Duck Down CEO Dru Ha said, "We hope he gets a fair trial. Duck Down will be there to support him 100%."
As one half of Heltah Skeltah, the baritone-voiced Rock also has been involved on several Boot Camp Clik albums. After signing with Interscope Records through DJ Lethal's Lethal Dose Records short-lived imprint, resulting in a shelved Planet Rock solo, the emcee returned to Duck Down, where he's appeared alongside partner Sean Price over the last two releases, as well as Boot Camp Clik albums.

TIFFANY 'NEW YORK' POLLARD DENIES SEX TAPE RUMOR
Lizzie Grubman, the publicist who famously mowed down a bunch of club-goers with her SUV in 2001, is now working for VH1 star Tiffany "New York" Pollard and denies that her client is involved in a sex tape currently making rounds on the Internet.
On Sunday, MediaTakeOut released what it claimed was footage of a sexual encounter between the Flavor of Love star and one of its "readers." The reader said "he and New York met up at a Miami club a few months ago and the two of them had a … A-HEM … romantic encounter together.”
Grubman released a statement Tuesday saying the story is not true. "Tiffany Pollard 100% did not participate in any sex tape of any kind."
According to People magazine, a source close to New York says she's very upset that her name is attached to the explicit footage being circulated.
"If she had a sex tape, she would admit to it," says the source, according to People. "That’s her personality. She has nothing to hide. For someone to make a sex tape and say it’s her — when it’s not — is just not right."
Meanwhile, New York is still engaged to her "I Love New York 2" winner Tailor Made, a.k.a. George Weisgerber, who is reportedly "upset that this happened to her," says the source. "But he supports her. He’s so in love with her."
Scott Storch Taken To Court Over Missed Child Support Payments
The mother of Scott Storch's child has filed court motions against the producer alleging that he has missed several child support payments.
According to court documents obtained by TMZ, Dalene Daniel (mother of Scott Storch's child) alleges that Storch missed December and January's child support payments for their daughter Jalen.
Storch is supposed to pay $7,500 per month in support payments.
Forbes estimated Storch's income in 2006 to be $17 million.
Fat Joe Reveals New Album Details
Fat Joe recently sat down with Billboard.com and revealed some details about his upcoming LP, The Elephant in the Room, his eighth solo LP since his debut in 1993.
According to Joe, he’s referring to himself and his legacy as a gangster rapper. “Elephant in the Room is a gangster rap album—rap being the room and the elephant being me.
Fat Joe’s been doing it for 15 years and he still doesn’t get his just due,” he explains. The project will include production from heavyweights and longtime Joe collaborators such as Scott Storch, DJ Premier, Swizz Beatz and Cool & Dre. Joe has also tapped Plies, Pooh Bear and DJ Khaled for guest appearances.
Notable tracks include the anti-snitching tune “Kill All Rats” and the recently leaked “300 Brolic.” Preemo contributed some of his trademark scratches to “Thank God For That White,” and “Preacher on a Sunday Morning” is described simply as “bass-heavy.”
One track sure to raise eyebrows is the song “Fugitive,” on which Joe raps “Nigga, bitch, hoe/some chicks is bitches, some chicks is hoes…Now who gonna tell me I can’t say nigga?”
Rick Ross To Walk Roy Jones Jr. To The Ring
Rick Ross is confirmed to walk Roy Jones Jr. to the ring to face Felix “Tito” Trinidad, this Saturday, January 19, 2008 at Madison Square Garden.
In conjunction with the event, Rick Ross has also partnered with the Susan G. Komen Foundation for breast cancer research. Don King, the fight's promoter, has donated $100,000 to the Foundation and hopes to raise one million dollars.
Trinidad is a five-time world champion with a stunning career knockout ratio of 80 percent who has won titles in the welterweight, junior middleweight and middleweight classes. Jones is an eight-time world champion, winning belts in the middleweight, super middleweight, light heavyweight and heavyweight divisions, becoming the first former middleweight champion to win a world heavyweight crown in more than 100 years.

Joe Budden Denies Shady Records Rumors
Despite rumors of Joe Budden being in heavy talks with Eminem's Shady Records, the rapper deaded the speculation, calling it just that -- rumors.
Via a recent interview, the rapper denied being close to signing with the label whose roster boasts 50 Cent, D12, Obie Trice and Cashis, but did not deny that the label may have contacted him.
"Yeah, that's a rumor," the New Jersey rapper told the site. "Far as me being in heavy talks with them... no. As far as us being close to closing a deal... no."
For those unaware, Joe Budden is currently a free agent, after severing ties with Island Def Jam last year after only one album and several delays on his follow-up.
Ultimately, his long awaited sophomore album, The Growth, was shelved indefinitely and to date, it doesn't look like it will see the light of day.
Since his release, he's released the third installment of his Mood Muzik mixtape series and is currently fielding offers for a major label deal.
In a December interview with Rhapsody.com, the rapper said that he's narrowed his choices down to three labels.
"I've narrowed where I'd like to be to three places. I'm going to end up at a major," Joe said, which should be finalized by summer of 2008
Snoop Dogg, David Beckham To Create Line Of House Slippers
After having David Beckham appear on his new E! reality show, rapper Snoop Dogg is now teaming up with the star soccer player for a new footwear line.
The footwear, however, will not be any type of athletic shoes; they will be a line of house slippers.
Apparently, Snoop sent the soccer star a pair as a present and that's how the idea came to realization, according to British newspaper, the Daily Mirror.
"I got David a pair of slippers as a present and he took a picture of him wearing them and sent it to me. I was like, 'They look cool,' Snoop exclaimed. "We are talking about making a slipper together. So when I stop rapping and he stops playing soccer, we can kick back and slip on a house shoe."
Also during the rapper's talk with the overseas paper, he revealed that David's wife, Victoria Beckham (a.k.a. Posh Spice) was initially not feeling that the two were hanging out.
Snoop said Victoria's reaction came from the public "bad boy" persona he carries.
"I met Victoria one time, at the Live 8 concert in 2005. She didn't like me much -- she didn't like my bad boy persona," the rapper said. "All she knew was, 'Snoop Dogg's a bad guy. I don't want my husband dealing with him - he's going to rub off on my husband.'
"But now she's seen my show, and I think I'm cool with her now that she knows I'm family orientated -- that I have a structure and a wife. Now she knows I'm a great person to rub off on her husband," he continued.

David Banner To Star In New Ice Cube Flick
David Banner will be showing off his acting chops in a new movie produced by legendary West Coast rapper Ice Cube.
The Mississippi rapper/producer, who has previously appeared in such major motion pictures as Black Snake Moan alongside Samuel L. Jackson and This Christmas, is set to appear in The Comeback, a film produced by Ice Cube for his Cube Vision film company.
Banner, who has reportedly been taking acting classes to strengthen his craft, will play the role of Maurice Hall. The Comeback will be directed by rap-rocker Fred Durst, former frontman of Limp Bizkit. This will be the second movie directed by Durst, who previously worked on The Education of Charlie Banks.
While Banner may be collecting checks from his acting skills, fans are still waiting to hear the rapper flex his lyrical skills on his long-awaited disc The Greatest Story Ever Told. The album, which features guest spots from a slew of hip-hop heavyweights including Lil' Wayne, Snoop Dogg, Yung Joc and R&B crooner Chris Brown, has seen it's release date steadily pushed back. Banner is hoping to have the CD hit the shelves sometime in early '08.
Jill Scott Partners With Ashley Stewart For New Plus-Size Line
R&B singer Jill Scott's company J Heather Inc. has reportedly entered into an exclusive joint venture deal with Ashley Stewart Stores to introduce a new line of intimate apparel for the plus-size woman, titled.
The new clothing line, The Butterfly Collection by Jill Scott, will be personally inspired and designed by Scott, in conjunction with Ashley Stewart whose name and image will be utilized in all marketing and merchandising concepts.
Scott's Blues Babe Foundation will benefit from the association with Ashley Stewart Stores Community Foundation. This has already begun with the launch of the Cecil B. Moore recreation center in Ms. Scott's hometown of North Philadelphia.

John Legend Releases Live Disc
Multi-platinum R&B singer John Legend is bringing his Philadelphia-based concert experience to homes everywhere with his new live CD/DVD.
Fans who missed Legend on the stage last year, during his "Show Me Tour," can now check it out from the comfort of their own couch. Live From Philadelphia, Legend's newest project, features the Grammy Award winning singer performing 19 songs, including a duet, "Where's the Love," alongside Corinne Bailey Rae.
The disc, available as either a CD or CD/DVD combo, features Legend favorites, "Slow Dance," "Ordinary People," and "Heaven," as well as covers of Sly & the Family Stone's "Dance to the Music" and the Beatles' "I Want You (She's So Heavy)."

Few people were surprised earlier this week when former Terror Squad MC and Big Pun protégé Cuban Link released a scathing diss track aimed at TS boss Fat Joe(Click here to hear it). The two have engaged in an on-and-off war of words for years now and the track, called “You’re Not Hood” and recorded over DJ Khaled’s hit single “So Hood,” just seemed like the latest chapter in an ongoing saga. Less expected however were the seemingly random jabs at Khaled himself and Miami native Rick Ross.
Ross recently sat down with Complex magazine to discuss his new album, Trilla and his plans for the new year. When asked what his response to the sneak diss was, Ross stated that, while he hasn’t heard the track yet, listeners shouldn’t expect any type of response from him anytime soon.

R. Kelly's Child Porn Case Judge Denies Doctor's Testimony
During a pre-trial court date on Jan. 14, the judge in R. Kelly's child pornography case said that he will not allow the prosecution to call a pediatrician to the stand.
The Pied Piper is facing charges that he videotaped himself having sex with a teenage girl, possibly as young as 14.
As previously reported, the girl who the prosecution believes was videotaped denies that it was her. So the team wants to bring in Dr. Sharon Cooper, a forensic and developmental pediatrician, to testify that denial is common among victims of child abuse.
This is the second time the prosecution has tried to get the doctor's testimony in, and the second time Judge Vincent Gaughan has denied the request.
"This doctor coming on would really be coming on to discuss credibility, and that's not beyond the ken of the jury," Gaughan said.
R. Kelly's defense lawyer, Ed Genson, said cases cited by prosecutors as precedent did not apply.
"There's a specific denial [by the girl] in front of the grand jury," Genson said.
Kells narrowly escaped being arrested last month when he missed a court date. Kelly didn't speak during today's (Jan 14) brief hearing. The case has been delayed for five years but is set for trial on May 9. Kelly's next court date is March 12.
Details Arise In Steroid Probe, 50 Cent & Timbaland Stay Tight-Lipped
Just days after several big celebs were named in a steroids probe, one might expect the stars' camps to be doing some serious spin work. But only one has proclaimed her innocence, while most others are staying tight-lipped.
As previously reported, Mary J. Blige, 50 Cent Wyclef and Timbaland are among the celebrities who have been named in the New York state steroid investigation.
So far, Mary's the only one to deny the claim. Blige's spokeswoman told New York's Daily News, that the singer "has never taken any performance-enhancing illegal steroids." Associates said she achieved such great shape by working out with New York City-based physical trainer Gregg Miele.
"I'm probably in the best shape that I've ever been in in my life," 37-year-old Blige told Billboard magazine in December. "I'm really healthy."
Timbo's camp sidestepped the allegations, refusing to comment. His manager Marcus Spence would only say, "Legally we're not allowed to make a statement at this time."
50 and Wyclef's reps haven't returned inquiring phone calls and have yet to make a statement
It is not apparent yet if any of the artists violated any drug laws.
The investigation -- dubbed "Operation Which Doctor" -- revealed that these celebs and others were linked to doctors and pharmacists who are accused of writing prescriptions for steroids and human growth hormones without examining the cients.
Actor/writer Tyler Perry was fingered in the probe as well. The Diary of a Mad Black Woman creator was a patient of Long Island chiropractor Michael Diamond, according to a friend of Perry's. Diamond is accused of receiving the steroids on behalf of the celebs from a doctor in Florida.
Diamond is also on staff at Clay Gym in Chelsea, as an anti-aging consultant where he works with many celebrities. Due to the alleged anti-aging effects of steroids, experts say many entertainers are attracted to the drug.
Diamond wouldn't comment yesterday, but his lawyer Robert Macedonio said his client maintains his innocence.
"He has not and he cannot receive prescriptions in the mail," Macedonio said, adding that Diamond has never met Gary Brandwein, the Florida doctor who The Albany Times Union reported was responsible for mailing the steroids. Brandwein, the same doc known for prescribing steroids to dead pro-wrestler Chris Benoit, is awaiting trial in Albany on drug charges.
Elsewhere, the charges are getting sticky. Ten people have pled guilty to felony drug charges and, Dr. Anna Maria Santi of Queens, N.Y. was sentenced to three to six years for forging hundreds of steroid prescriptions.
Grammy Awards May Be Cancelled
The New York Daily News is reporting that The Grammy Awards may be cancelled due to pressure from the striking members of The Writers Guild of America.
According to reports, the WGA members may picket the awards show. There are also plans in place to have musicians with film credentials such as 50 Cent, Justin Timberlake and Fergie, among others, to boycott the show.
"The writers are especially interested in artists who might perform on the show," a source said. "If they pull out, the show comes apart.", "As of now, the Guild has not taken a position on the Grammy's," a WGA spokeswoman said.
Many of the nominated artists and those scheduled to perform at this year's show have TV and film experience and a boycott would seriously hamper the ability to put on this year's Grammy's.
VIVICA A. FOX CLAIMS THERE IS NO SEX TAPE
Film and TV star Vivica A. Fox is denying that she is the woman featured in a sex tape that has been circulating on the Internet.
"Vivica does not have a sex tape. If I did, I would be making my own money off of it," the actress told People magazine Saturday night at the taping of the inaugural BET Honors in Washington, D.C.
The video in question shows a man receiving oral sex from a woman he claims is Fox. The man, as the story goes, filmed the act and then distributed the footage to his friends, which eventually got back to Fox. The actress allegedly contacted a friend in the police department for advice on how to handle the situation.
Atlanta radio personality Porsche Foxx reportedly confirmed the story, calling Fox her friend and expressing a labored decision on whether to go public with the story.
The "Kill Bill" star didn't comment directly on the latter part of the rumor, but reaffirmed to People: "As a 43-year-old woman, I would never allow a man to put me in that position. If you see me having a love scene, it's going to be choreographed in a movie, and be fabulous."
As for her no contest plea to DUI charges last December, Fox says she's learned a valuable lesson: "Hire a driver."
"I gave Nicole Richie that advice – hire a driver," she says. "It's a lesson I definitely learned. No one is above the law."
Illegal Rap Radio Station Gets Busted
Three people were arrested yesterday (January 14) after authorities in Florida shut down a rap-themed radio station that was operating without an FCC license.
According to local Tampa Bay news network, WTSP, the Polk County Sherrif's Department in Winter Haven Florida arrested three people; Calvin Thompson, 24, Jimessia Spillman, 23 and Wesley C. Williams Jr., 21, after admitting to running an illegal gangsta-rap station on FM radio.
Williams, who is from Winter Haven and known as "DJ Blue," worked on the station anywhere from 10 to 15 times. Spillman, also of Winter Haven, allegedly operated the station for her boyfriend, Williams, and Thompson reportedly admitted to paying the station $700 over a period of 3 months for advertising a local establishment called The Jamaican Lounge.
"This illegal FM radio station broadcasted 'gangsta rap' with violently offensive language," said Sheriff Grady Judd. "We believe one purpose of this station was to glamorize and encourage criminal gangster activity."
The three were charged with unauthorized transmission/interference with a licensed radio station, a third degree felony, and booked into Polk County jail. Sheriff Judd emphatically rejoiced in the department's work to bring the station to an end.
"Working in partnership with the State Attorney's office and the FCC, we have crushed this illegal operation," Judd said.
Ice Cube Talks 'Welcome Back, Kotter' Remake
Nearly 30 years since it left the air, "Welcome Back, Kotter" is slated to make a return and Ice Cube is leading the way.
According to a recent interview with MTV, the rapper-turned-box-office-star revealed that a script is there, but it would have an urban take on the 70s sitcom, with himself playing Mr. Kotter.
"There's a script," Cube said. "We've got the same characters, they're just re-vamped to suit the times, totally different. It's like, flipped. With me playing Kotter, how couldn't it be?"
In addition to the urban re-vamp, the new "Welcome Back" will also lose a few other things regular to the show -- including Mr. Kotter's uncle jokes, John Travolta's Barbarino dance and Epstein bringing in phony letters from his mother. But, Cube maintained that all the most of the original ideas and concepts will be all the same.
"I'm gonna flip it. It ain't gonna be no Gabe Kaplan sh--," he said. "The names will be saved, don't worry about it. Everybody will have the same name. To me, it's still a comedy, but it's real. It's more of a 'Fast Times at Ridgemont High,' not so much 'Up your nose with a rubber hose.' "
Although the re-make is not 100% confirm, Cube says that if it does take place, he plans to get some of the old cast down with the movie.
"I want everybody," explained the rap veteran. "I want Travolta for a cameo, I want Gabe Kaplan for a cameo. I want Epstein, Horshack, Washington. If they do [make the movie], I want 'em in."
"Welcome Back, Kotter" originally began in the 70s, and tells the story of a former high school troublemaker who returns to his New York stomping grounds to teach a new generation of troubled students. It helped to launch the career a young John Travolta at the time.
Protesters Rally Outside of BET Honors Event
The BET Honors award show was recently recorded in Washington D.C. on Sunday. And although the show made a valiant attempt to do its part for the community by honoring distinguished African Americans, protests against the network took place right outside the ceremony.
Maryland pastor, Rev. Delman Coates, brought thousands of people with him by bus to protest the network’s portrayal of African Americans outside of the Warner Theater in Washington D.C. as Tyra Banks, Cornel West, Alicia Keys and others accepted their awards.
The protesters carried signs like “I’m Not a Pimp,” “I’m Not a Gangster” and “BET Does Not Represent Me.”
The efforts were to put an end to “The music and video content (shown) by this network that degrades women of color, that negatively stereotypes black men and glorifies criminal activity,” Coates stated.
“(My daughter) grows up with negative images of herself,” a protester said outside the invitation only event. “She doesn’t know that she is a princess and a queen and that she can be anything if she only sees pimps, prostitutes and profanity spoken on that station.”
Actress Vivica A Fox came to the defense of the network. “You’re not going to always make everyone happy,” she stated. “But the fact that you are providing opportunity and employment for others is what is important to me.”
Wyclef also chimed in lending his support to the network. “They have always put our culture to the forefront, negative or positive,” he says. “And the positive has always outweighed the negative.”
Khia Signs to Big Cat Records
Female rapper Khia, best known for her 2002 single “My Neck, My Back (Lick It),” has inked a new recording deal with Atlanta-based Big Cat Records.
Prodigy Shoots Music Video Behind Bars
After being granted a thirty day grace period before having to report to jail on weapons charges, Mobb Deep rapper Prodigy has decided to shoot his new music video inside a prison cell.
Reports from New York's Daily News confirm that Prodigy, whose real name is Albert Johnson, received permission from officials at the Queens House of Detention to film a video there. According to corrections officials, Prodigy paid for use of the cell.
P on the other hand is denying that the judge allowed him extra time because of his disease. The Queens emcee recently released another video on his website hnic2.com claiming he asked for the extension in order to have more time to put his career in order.
In the eleven minute clip, P explains that he asked his lawyer Irving Cohen to request an extension for business reasons, not health ones.
Prodigy is expected to begin serving his sentence in early February. His second solo album, H.N.I.C. Part 2, is due out this March.
Twista Launches New Label, Preps Crew Album
Chicago veteran Twista has launched a new record label called the Get Money Gang, and he is preparing for the release of the imprint’s first project from the Speedknot Mobstaz.
The Chicago based duo, which consists of MC’s Liffy Stokes and Mayz, notably appeared on Twista’s 1997 LP Adrenaline Rush.
They released their debut album, Mobstability in 1998 and went on to tour with Twista and appear on a number of the rapidfire MC’s follow up albums. The Mobstaz latest project, Mobstability II: Nation Bizness will be distributed by KOCH Records and features appearances from Twista and Jim Jones.
“The album is the streets just like the first one was,” says Mayz. “We don’t have to create a fake image; we just have to let our soul speak to the people.”
Production duties on the project were handled by Chi-town producer Cuzzo and China White Productions.
Joell Ortiz Dropped From Aftermath?
Was Brooklyn MC Joell Ortiz dropped from Hip Hop power label Aftermath?
According to label mate Bishop Lamont, he very well may have been. In a recent interview, Lamont said Ortiz might have been dropped after expressing his [Ortiz] grief with some of the label execs over the web and in interviews.
"From what I heard, I think he got dropped--don't quote me-- but I think dude got dropped because of the whole Interscope thing."
Last November, in an interview with XXL Mag, Joel said he didn't feel as if he was wanted at Interscope citing word of a possible release.
“First, Aftermath called and said that Jimmy Iovine doesn’t want me there…I don’t even know Jimmy Iovine. I never even met him. [They said] ‘I don’t know what’s going on with Aftermath. The word is that they thinkin’ ’bout letting you go.’ I’m like, ‘Let me go? I got all this buzz, putting out good records, I’ve got XXL covers on my own!’ This information was comin’ from within Aftermath,” Ortiz told XXL late last year.
"What he said wasn't wrong," said Bishop. "But what Joel didn't have a chance to experience coming in-- was the politics that go on in any label. He felt that it was something personal--that's business." Bishop continued.
Ortiz was officially signed to Dr. Dre's Aftermath imprint in the Summer of 2006.
In 2003 Ortiz won the EA Sports Livestyle MC battle landing him a spot on the NBA Live 2005 soundtrack as well as a record deal with Jermaine Dupri’s So So Def. However, the So So Def deal never materialized.
In 2007, Joell released The Brick through Kotch Records.
No official word has emerged regarding Ortiz's situation with Aftermath.
Hip-Hop Violinist, Miri Ben-Ari, To Be Honored In Israel
Israeli musician, Miri Ben-Ari, whose known throughout the hip-hop industry as the Hip-Hop Violinist, is salted to receive the first ever Martin Luther King, Jr. Israeli Award on Tuesday (January 15) in Jerusalem.
Ben-Ari is being recognized by the Fellowship of Israel and Black America for her outreach to the African-American community, particularly through her song and video "Symphony of Brotherhood."
The single was used as a PSA for the Viacom Dream Concert at Radio City Hall, which took place in September of 2007.
She will be presented the honor by Israeli President Shimon Peres.
FIBA, which was founded by Pastor Glenn Plummer, aims to establish a permanent Martin Luther King Center and Memorial in Jerusalem to promote unity in Israel.
"Being a third generation to Holocaust survivors, I have always believed in the fight against racism," Miri Ben-Ari said.

In response to an Okayplayer message board posting, Prolyfic, a former producer for Lupe Fiasco's 1st & 15th production company has fired back at the chi-town over what he perceives to be false claims.
The controversy started when Lupe Fiasco wrote the following message board posting at Okayplayer.com:
